General Terms and Conditions

1. Subject matter of the contract
sole e gusto gmbh sells the goods specified in the online shop to the customer (hereinafter referred to as "customer") in accordance with the terms and conditions of delivery and sale (GTC) listed below.

2. Conclusion of contract
The contract between the customer and sole e gusto gmbh is only concluded upon the customer's order and its acceptance by sole e gusto gmbh. The customer's order is placed by telephone, in writing, or via the Internet. sole e gusto gmbh accepts the order by (a) sending the customer an order confirmation (by fax, email, or letter) or (b) delivering the ordered goods with an invoice/delivery note in accordance with the payment and delivery terms specified in Section 4.

3. Product range
All information regarding the goods provided to the customer during the ordering process is non-binding. In particular, we reserve the right to make changes in design and technology that improve the functionality of a product, as well as errors in descriptions, illustrations, and pricing. The prices quoted are valid at the time of purchase. Periodic price changes are reserved. All technical information regarding individual goods is based on information provided by the manufacturers and is binding within this framework. Our product range (products, vintages, etc.) is subject to constant change. We reserve the right to make short-term changes to the product range and vintages, prior sale, and quantity restrictions for individual items.
If a variety or vintage is out of stock, we will amend your order without further notice and deliver the best possible replacement or the following vintage. This way, your order will not lose any applicable volume discount. If you do not wish this, please inform us accordingly when placing your order.

The purchase of tobacco products and alcoholic beverages is prohibited by law in Switzerland for persons under 18 years of age. By purchasing such products, you confirm that you are 18 years of age or older.

4. Delivery conditions
If in stock, products are usually delivered to the address provided by the customer within 2-3 business days (Switzerland & Liechtenstein) or 4-8 business days (Germany & Austria). All items not in stock are usually delivered within 4 to 15 days, depending on availability. If the customer is not at home at the time of delivery and no special delivery instructions have been provided, the goods will be left in front of the apartment door. Goods can also be left with neighbors living in the same building. For this, their address and telephone number are required. Delivery of the goods is at the customer's expense and risk. Claims for externally visible damage to the ordered goods will only be settled upon presentation of a certificate from the respective carrier.

5. Terms of payment
The catalog prices are guide prices and are continuously adjusted to the market. They are quoted in Swiss francs (CHF) including statutory VAT. Transport and packaging costs are billed separately. Payment is generally due net within 10 days of invoicing. Late payment will result in the blocking of the customer account. A reminder fee of CHF 10.00 will be charged from the second reminder onwards. sole e gusto gmbh reserves the right to only supply new (and existing) customers against advance payment or cash payment.

6. Retention of title
The delivered goods remain the property of sole e gusto gmbh until full payment has been made. Sole e gusto gmbh is entitled to make a corresponding entry in the retention of title register. If the customer defaults on payment of the purchase price, sole e gusto gmbh is entitled to withdraw from the contract (declaration of withdrawal) and take possession of the goods.

7. Right of return
The customer assumes responsibility for the delivered products, even if they were left in front of the customer's door or with a neighbor in their absence. The customer has the right to revoke the contract within five working days without stating reasons and to return the goods. The delivered goods must be returned undamaged, functional, complete, and in perfect original packaging, including the invoice number. If the above conditions are not met, we charge a processing fee of CHF 30. The right of return begins upon receipt of the goods by the customer. The customer also bears the return costs. The right of return only applies to unopened, original packaging. Second-hand and second-choice products, items with price reductions, and those specially manufactured at the customer's request are generally excluded from the right of return. If the customer returns the goods on time and correctly, sole e gusto gmbh will issue a credit note or, if requested, a replacement delivery.

Cork wines:
Bottled wines can be returned within two years of the order being placed, provided the bottle is still at least three-quarters full. We will be happy to replace your wine promptly and free of charge.

8. Warranty and liability
The warranty for all electrical appliances is 12 months from the date of purchase, unless a different warranty period is expressly stated. The warranty is void if modifications or repairs are made to the product without the written consent of sole e gusto gmbh. To the extent permitted by law, liability for damages is excluded. In particular, sole e gusto gmbh is not liable for damage resulting from improper use or natural wear and tear, or for damage not caused by the delivered item itself (consequential damage).

9. Intellectual Property
sole e gusto gmbh reserves all rights to all designs, texts, and graphics in its print and online media. Copying or any other reproduction of all or part of the print and online media is permitted only for the purpose of placing an order with sole e gusto gmbh. All trademarks, product names, company names, and logos cited in the print and online media are the sole property of their respective owners. sole e gusto gmbh reserves all ownership and copyright to images, drawings, calculations, and other documents. The customer must obtain express written consent from sole e gusto gmbh before passing them on to third parties.

10. Data protection
sole e gusto gmbh guarantees to comply with the provisions of the Swiss Data Protection Act and the relevant legal norms when collecting, processing, and using personal data. Customer data collected during order processing will be used solely for internal market research purposes. Data will only be shared with third-party partner companies to the extent absolutely necessary for the proper provision of services (order processing). The customer consents to this use of their data. We reserve the right to inform the customer by email about sole e gusto gmbh and its latest developments.

11. Place of jurisdiction and applicable law
These Terms and Conditions and the contracts concluded based on them are governed by Swiss law. The place of jurisdiction is Lyss.

12. Final provisions
For the sale of goods specified in the sole e gusto gmbh online shop, the General Terms and Conditions in effect at the time of the respective contract conclusion apply exclusively. These General Terms and Conditions shall apply in particular even if they deviate from those of the customer. Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the legal validity of the remaining provisions. Furthermore, sole e gusto gmbh reserves the right to amend these General Terms and Conditions at any time.
